DATA LOCALISATION IS GOOD BUT NEEDS DISTINCTION-CAIT
CAIT HAS SOUGHT PM’s INTERVENTION
In the wake of crucial issue of “data localisation” wherein the Reserve Bank of India has directed the Companies, Banks & other Institutions conducting activities in India to store their respective data secured from India within the Country, the Confederation of All India Traders (CAIT) has sought intervention of the Prime Minister to make distinction between such Companies or Institutions those who have real time data and others who use primary data for making transactions to happen.
While extending its support to the Government and the RBI on its bold move towards protecting Indian citizens’ data and privacy by ensuring the data is stored within infrastructure in India, the CAIT has said that it will go a long way in moving India towards a data driven economy and the possibilities of misuse or unauthorised usage of data will be minimised.
The CAIT has also sent copy of PM’s letter to RBI Governor, Finance Minister Shri Arun Jaitley, Minister for IT Mr. Ravi Shankar Prasad, BJP President Shri Amit Shah & others.
At a Press Conference held today at New Delhi, CAIT Secretary General Mr. Praveen Khandelwal said that in his communication to Prime Minister it is said that large variety of Institutions secure data for various purposes and therefore some sort of distinction needs to be made among such Companies or Institutions. Same Yardstick can not be applied for one and all in the larger interest of economy. Therefore, there is a need of a distinction to be made between entities which have access to personal data and those who use the data only for enabling commerce through activities for example like payments.
In our considered view digital platforms (like Facebook, Amazon, Google etc) and Banks have access to personal consumer data such as name, address, contact details and other such know your customer ( KYC) data. This is used by entities above to provide their services. Such data should necessarily be stored in India to prevent any misuse, including for political purposes.
On the other side there are various Companies particularly the payment technology companies (Visa, Mastercard, RuPay) which only have a 16 digit card number which is stored with them, and as such that is not personally identifiable data and should not be forced to be stored in India, as it does not serve any purpose with regards to law enforcement, or misuse.
Mr. Khandelwal said that we have been strongly driving “digitization of payments” as an agenda for our small traders over the last five years. T Any move now to localize this payments data will nullify all of our efforts made over the past, and also bring in added risk and weaken the trust of our community with regards to digital trade. We would also like to state on record that such a move will cut us off from global fraud and security systems, which have provided immense value to our small traders by offering services like chargebacks, safety checks etc. which prevent any fraudulent transaction.
The concept of data localization is also concerning to us from a payments technology standpoint, as the same has been promoted in the draft data privacy bill and the earlier ecommerce policy.
The CAIT has urged the Prime Minister to ensure data localization is enforced strongly for banks and digital platforms and not towards financial data, which should not be classified as sensitive data, as that will also severely limit the development of the Indian fintech companies, along with the broader payments ecosystem.

Bibi’s husband Ashiq Masih and their two daughters, currently in London, anxiously await her safe release and reunion with her after eight years of wrongful detention.
Asiya Bibi was convicted in 2010 after being accused of insulting Islam in a row with her neighbours. She always maintained her innocence, but has spent most of the past eight years in solitary confinement.
A three-judge special bench headed by Chief Justice of Pakistan Justice Mian Saqib Nisar and comprising Justice Asif Saeed Khosa and Justice Mazhar Alam Khan Miankhel heard Bibi’s 2014 appeal against her conviction and death sentence under section 295-C of the Pakistan Penal Code (PPC).
The chief justice wrote that it was a “well settled principal of law that the one who makes an assertion has to prove it. Thus, the onus rests on the prosecution to prove guilt of the accused beyond reasonable doubt throughout the trial. Presumption of innocence remains throughout the case until such time the prosecution on the evidence satisfies the court beyond reasonable doubt that the accused is guilty of the offence alleged against him.”
The top judge added that the expression “proof beyond reasonable doubt” was of fundamental importance to the criminal justice and was one of the principles which sought to ensure that no innocent person was convicted.
CJP Nisar added, “Keeping in mind the evidence produced by the prosecution against the alleged blasphemy committed by the appellant, the prosecution has categorically failed to prove its case beyond reasonable doubt. The judgments of the High Court as well as the Trial Court are reversed. Consequently, the conviction as also the sentence of death awarded to the appellant is set aside and she is acquitted of the charge. She be released from jail forthwith, if not required in any other criminal case.”
Further, Justice Khosa “because of some important legal and factual issues involved in the case” decided to record his separate concurring opinion which stated that the prosecution had failed to prove its case against Asia Bibi beyond a reasonable doubt. “This appeal is, therefore, allowed, the conviction and sentence of the appellant recorded and upheld by the courts below are set aside and she is acquitted of the charge by extending the benefit of doubt to her,” he stated.
Justice Khosa’s opinion added, “Blasphemy is a serious offence but the insult of the appellant’s religion and religious sensibilities by the complainant party and then mixing truth with falsehood in the name of the Holy Prophet Muhammad (Peace Be Upon Him) was also not short of being blasphemous.”
“It is ironical that in the Arabic language the appellant’s name Asia means ‘sinful’ but in the circumstances of the present case she appears to be a person, in the words of Shakespeare’s King Leare, “more sinned against than sinning,” Justice Khosa’s opinion read.
The Supreme Court on Wednesday asked the Centre to file an affidavit within 10 days in a sealed envelope on the pricing details and advantages of the Rafale deal.
A bench headed by Chief Justice Ranjan Gogoi said, “Such details that may be considered strategic may not be furnished to the petitioners.”
The court asked for documents in the public domain to be made available to the petitioners.
A bench comprising Chief Justice Ranjan Gogoi and Justices U U Lalit and K M Joseph also asked the Centre to share information which can be brought in the public domain with the petitioners.
The top court, which has now fixed the matter for hearing on November 14, said documents considered strategic and confidential may not be shared.
CJI Ranjan Gogoi told petitioners that the CBI probe in the Rafale deal will have to wait.

Actor Arbaaz Khan was recently witnessed in New Delhi for the promotions of his upcoming Bollywood romantic comedy film Jack and Dil. Along with Arbaaz director of the film Sachin P. Karande and actor Rajdeep was also present to interact with media in a press conference held at HotMess Kitchen & Bar, Connaught Place. Produced by Sagar S. Sinagare, Sandesh Jadhav, Yogesh Singh. As per the details revealed Jack and Dil is a story of new age man Jack, carefree with little materialistic ambitions. Jack (Amit Sadh), a comical detective is hired by Waliaji (Arbaaz Khan) to spy on his wife Shilpa (Sonal Chauhan) when he suspects her of having an affair. The movie got twisted when Jack ends up falling in love with his client’s wife.
On asking about the film & character Arbaaz stated, “If you see basic of the film, husband-wife, lover, it’s a simple concept but the presentation of the film should make film different. You can say this film is on extramarital, you have already seen such a concept but when you will watch this film it’s a different presentation the entire take is very interesting. My experience in this film was really good, like before I played husband and brother roles. In this film, I got a different character. I really enjoyed playing this kind of insecure character. There are few twists and turns in our film, which is the USP and I am sure people will like it.”
On asking about his upcoming projects and Dabangg 3, further Arbaaz added, “Well, Dabangg 3 is going to start next year around March and will try to release it same at the end of same year. The entire schedule of Dabang is starting at the right time; it will come in 2019 end.”
Well, Jack and Dil, written by Sanjeev Dutta, it also stars Amit Sadh, Sonal Chauhan, Arbaaz Khan and Evelyn Sharma in lead roles. Featured under the banner of Balcony Films and Entertainment the film is slated to release on 2nd of November.

Chandigarh, October 30, 2018: The Professional Golf Tour of India (PGTI) and TAKE Solutions have jointly launched the Jeev Milkha Singh Invitational presented by TAKE Solutions. The tournament will be staged at the esteemed Chandigarh Golf Club from November 1 – 4, 2018. The main event will be preceded by the Pro-Am on October 31.
The tournament, in its third edition, has been renamed from ‘TAKE Open Golf Championship’ to ‘Jeev Milkha Singh Invitational presented by TAKE Solutions’ as a gesture to honour Indian golfing legend Jeev Milkha Singh.
The event which will be staged at Jeev’s home course, the Chandigarh Golf Club, will offer a whopping Rs. 1.5 crore in prize money, the highest-ever for an event in Chandigarh.
The tournament is set to feature one of the strongest fields ever in Chandigarh. The week will see India’s leading golfing stars in action including the likes of Jeev Milkha Singh, Shiv Kapur, SSP Chawrasia, Jyoti Randhawa, Khalin Joshi, Ajeetesh Sandhu and Viraj Madappa, to name a few.
Shiv Kapur will be playing a professional event at the Chandigarh Golf Club for the first time while SSP Chawrasia returns to the venue after a gap of seven years. Khalin Joshi is India’s newest international winner as he bagged the Asian Tour’s Panasonic Open India in Delhi last week. Joshi is also the current PGTI Order of Merit leader.
The foreign challenge will be led by the likes of Bangladesh’s Md Siddikur Rahman and Sri Lankans Mithun Perera, N Thangaraja and Anura Rohana.

Seventeen-year-old Aadil Bedi and 21-year-old Yuvraj Singh Sandhu also hail from Chandigarh. Kshitij Naveed Kaul, another 17-year-old, had an impressive tied sixth finish on his professional debut at the Panasonic Open India last week.
This is the first time that a PGTI event has been named after an iconic Indian professional golfer. Jeev Milkha Singh conquered uncharted territory over two decades back when he became one of the first Indian golfers to taste success at the international level. Since then he has added many more firsts and Indian records to his name.
Jeev has the rare distinction of being the only Indian to have won the Asian Tour Order of Merit twice (in 2006 & 2008). He has won multiple titles on the European Tour, Japan Golf Tour and Asian Tour and has 14 Major appearances to his name. Jeev has also achieved a career-high world ranking of 28, an Indian record.
A thrilled Jeev Milkha Singh, said, “When Mr. Srinivasan informed me about this event, there were three things that I was excited about. Anand Mazgaonkar, a community group leader in Narmada district of Gujarat state where the statue has been built over the past four years, said plain clothes police took away 12 people late Tuesday to the local police headquarters.
Police denied they had made any detentions. But authorities are taking no chances in case community groups stage protests to demand compensation for land taken to erect the Statue of Unity, which cost INR29.9 billion ($400 million).
“More than 5,000 police personnel have been deployed at various points in the 10 kilometre radius of the statue site,” said Narmada police inspector general Abhay Chudasama.
