Dear Friends,
The Chhattisgarh Election Watch and Association for Democratic Reforms (ADR) have analysed the self-sworn affidavits of 1256 out of 1269 candidates, who are contesting in the both phases of Chhattisgarh Assembly Elections. Out of all 1269 candidates, 237 are from national parties, 156 are from state parties, 315 are from registered unrecognized parties and 561 candidates are contesting independently.

Criminal Background

·        

Criteria for serious criminal cases

1.       Offence for which maximum punishment is of 5 years or more.

2.       If an offence is non-bailable

3.       If it is an electoral offence (for eg. IPC 171E or bribery)

4.       Offence related to loss to exchequer

5.       Offences that are assault, murder, kidnap, rape related

6.       Offences that are mentioned in Representation of the People Act (Section 8)

7.       Offences under Prevention of Corruption Act

8.       Crimes against women.

 

Candidates with Criminal Cases: Out of 1256 candidates analyzed, 145 (12%)candidates have declared criminal cases against themselves. In 2013 Chhattisgarh Assembly Elections, out of 983 candidates analysed, 113(11%) had declared criminal cases against themselves.

·        Candidates with Serious Criminal Cases: 98 (8%) candidates have declared serious criminal cases, including cases related to attempt to murder, kidnapping, etc.  In 2013 Chhattisgarh Assembly Elections, 66 (7%) candidates had declared serious criminal cases against themselves.

 

·        Candidates with cases related to Attempt to Murder: candidates have declared cases related to attempt to murder (Indian Penal Code Section-307).

·        Candidates with cases related to Kidnapping: 3 candidates have declared cases related to kidnapping such as Kidnapping or abducting with intent secretly and wrongfully to confine person (IPC Section-365) and Kidnapping, abducting or inducing woman to compel her marriage, etc. (IPC Section-366).

·        Candidates with cases related to Crime Against Women:  candidates have declared cases related to crime against women such as  Husband or relative of husband of a woman subjecting her to cruelty (IPC Section-498A), Word, gesture or act intended to insult the modesty of a woman (IPC Section-509), and Assault or criminal force to woman with intent to outrage her modesty (IPC Section-354).

·        Party wise Candidates with Criminal Cases:  Among the major parties6(7%)out of 90 candidates from Bharatiya Janta Party (BJP) 25(28%) out of 90 candidates from Indian National Congress(INC), 17 (21%) out of 83 candidates from AAP, 18(32%)out of 56 candidates from Janta Congress Chhattisgarh (J),  3(9%) out of 34 candidates from BSP, and 39 (7%) out of 556 Independent candidates analysed have declared criminal cases against themselves in their affidavits.

·        Party wise Candidates with Serious Criminal Cases Among the major parties15(17%) out of 90 candidates from Indian National Congress (INC), 13 (16%) out of 83 candidates from AAP, 16(29%) out of 56 candidates from Janta Congress Chhattisgarh (J), 2(6%) out of 34 candidates from BSP, and 26 (5%) out of 556 Independent candidates analysed have declared serious criminal cases against themselves in their affidavits.

·        Red Alert Constituencies*: There are 18(20%) out of 90 constituencies in the Chhattisgarh assembly elections having 3 or more candidates with declared criminal cases. During Chhattisagarh Assembly Elections 2013, there were 10 (11%) red alert constituencies.

*Red Alert Constituencies are those which have 3 or more candidates with criminal cases contesting elections.

·        Party wise Crorepati Candidates: Among the major parties 74(82%) out of 90 candidates from BJP, 66(73%) out of 90 candidates from INC, 39(70%) out of 56 candidates from Janta Congress Chhattisgarh (J), 13(16%) out of 83 candidates from AAP14(41%) out of 34 candidates from BSP and 52 (9%) out of 556 Independent candidates have declared assets worth more than Rs. 1 crore.

·        Average assets: The average of assets per candidate contesting in the Chhattisgarh Assembly Elections is Rs 1.68 Crores.  In 2013 Chhattisgarh Assembly Elections, average assets per candidate for 983 candidates was Rs. 1.42 crores.

·        Party wise average assets: Among major parties, the average assets per candidate for 90 BJP candidates is Rs. 4.51 crores90 INC candidates is Rs 10.02 crores83 AAPcandidates have average assets of Rs 93.91 lakhs, 56 JCC (J) candidates have average assets worth Rs 5.23 Crores, 34 BSP candidates have average assets worth Rs 1.11 crores, and 556 Independent candidates have average assets of Rs. 45.94 lakhs.  

·        Zero asset candidate: 19 candidates have declared zero assets in their self sworn affidavits.

Other Background Details

·        Education details of candidates: 724 (58%) candidates have declared their educational qualification to be between 5th and 12thwhile 452 (36%) candidates have declared having an educational qualification of graduate or above41 candidates have declared themselves to be just literates and 9 candidates are illiterate.

·        Age details of candidates: 519(41%) candidates have declared their age to be between 25 to 40 years while 615 (49%) candidates have declared their age to be between 41 to 60 years.  There are 121(10%) candidates who have declared their age to be between 61 to 80 yearscandidate has declared his age to be above 80 years.

Gender details of candidates: 125(10%) female candidates are contesting in the 2018 Chhattisgarh assembly election this year.  In 2013 Chhattisgarh Assembly Elections,81(8%) out of 983 candidates analysed were women.
